H.R. 5749 would provide for a program of emergency unemployment compensation.
Detailed Summary
Emergency Extended Unemployment Compensation Act of 2008 - (Sec. 2) Authorizes a state to enter into an agreement with the Secretary of Labor under which the state agency will make emergency unemployment compensation payments to individuals who: (1) have exhausted all rights to regular compensation under state or federal law with respect to a benefit year ending on or after May 1, 2007; (2) have no rights to regular compensation or extended compensation with respect to a week under such law or any other state or federal unemployment compensation law; and (3) are not receiving compensation for such week under the unemployment compensation law of Canada.
Authorizes a state's governor in an extended benefit period, if state law permits, to provide for the payment of emergency unemployment compensation before extended compensation to individuals who otherwise meet the requirements of this Act.
(Sec. 3) Requires such agreements to require states to establish an emergency unemployment compensation account for an applicant's benefit year.
Prescribes a formula for crediting amounts to such accounts.
Makes a special rule to augment the compensation amount if such an account is exhausted while the state is in an extended benefit period. Revises the definition of "extended benefit period" to include states with a total unemployment rate (TUR) of at least 6.0% and states with an insured unemployment rate (IUR) of at least 4.0% (regardless of certain other ordinary requirements).
(Sec. 4) Requires federal payments to states that have entered into such agreements to cover 100% of emergency unemployment compensation payments.
Prohibits such payments from being made to any state if it is entitled to reimbursement in respect of such compensation under any federal law other than this Act or federal law relating to unemployment compensation for federal employees and ex-servicemen.
Denies a state entitlement to any reimbursement under the latter law if the state is entitled to reimbursement under this Act.<br>
(Sec. 5) Requires funds in the extended unemployment compensation account of the Unemployment Trust Fund to be used for payments to states having such agreements.
Appropriates out of the employment security administration account of such Fund, without fiscal year limitation, the funds necessary to assist states in meeting the costs of administration of such agreements.
Appropriates from the general fund of the Treasury, without fiscal year limitation, to the extended unemployment compensation account of the Unemployment Trust Fund such sums as the Secretary estimates are necessary to make payments for: (1) compensation payable to federal employees and ex-servicemen; and (2) compensation payable on the basis of certain services performed for nonprofit organizations or governmental entities. Declares that none of these appropriations shall be required to be repaid.
(Sec. 6) Makes an individual ineligible for further emergency unemployment compensation, and subjects him or her to fines and imprisonment of up to five years, or both, if the individual knowingly has made, or caused another to make, a false statement or representation of a material fact, or knowingly has failed, or caused another to fail, to disclose a material fact, and as a result of such actions the individual has received such emergency unemployment compensation to which he or she was not entitled.
Directs the state to require such an individual to repay the compensation to the state agency unless the state determines that: (1) the overpayment was without fault on the individual's part; and (2) such repayment would be contrary to equity and good conscience.
(Sec. 8) Requires any agreement entered into under this Act to apply only to weeks of unemployment: (1) beginning after the agreement is entered into; and (2) ending on or before February 1, 2009.

the problem with unemployment statistics is this, as soon as your benefits aare depleted you are no longer counted. what most people want are jobs, since there are none to be had, give them their 13 weeks extension, especially in NJ we are begging you for help!!

I as well need this extension. I have not worked since 09/2007. I am able, willing and seeking work here in Michigan, outside Detroit. My benefits are exhausted. I am 45 years old and never drew unemployment until Sept/2007. I have always worked and paid my taxes fairly. I am very worried if this bill will not pass. I have sold most I own on C.L. It is expensive just seeking work, Insurance for car and gas basically took half of my benefits when I had them. Hundreds of resumes, very few interviews...many hundreds of emails to job sites...all to only still be unemployed.

I have a degree and have been employed in the homebuilding industry for 20 years. Last October my pay and hours were cut until the company closed its doors for good in January this year. I have been unsuccessful in finding any kind of a job with liveable wages or reasonable opportunity for growth. I had, with foresight, saved for this eventuality, but will have exhausted all my resources this month. I will take a job at $9.00 as a last resort. and I am working towards beginning a homebased business. I just need a little more time.

I've been out of work since the company I was working for was closed last year. Through no fault of my own I have been unable to find work of any kind. Now with my benefits exhausted and my bank acount drained I can no longer afford to drive to an interview, let alone eat or afford the basics of life. I cannot wait a month and a half to get extended benefits. By the time they come through (if they come through) I will have died from starvation. Yeah I know I can go to a food bank, but without the gas to get there...This is a supposed to be a government of the people, by the people and for the people...apparently the people in government don't give a damn about the people they are supposed to represent...We needed this yesterday...for me it's too late...I wonder if they realize just how bad off the people really are or if they even care!!! We can help the people in the rest of the world...it's time to help those of us here at home!!!

Unemploymnent Insurance is exactly that - INSURANCE into which both employers and employees (depending on the state) have paid into DURING THE EMPLOYEES' WORKING LIVES to provide for hard times when they have been laid off for reasons NOT CAUSED BY THEM. If they are responsible for the layoff, they are not eligible for unemployment benefits. The extension would not be a government "handout", merely a guarantee to extend the six months of INSURANCE BENEFITS they are entitled to receive for a few more weeks to hold them over. I am a 62-year old woman who has worked her whole life who was one of the thousands of people laid off by Bank of America and other financial institutions. How dare you try to make me feel worse than I already do? If you are working and have time to post to this blog, perhaps you are one of the lazy asses who are on the internet on their jobs while they should be working! I'll keep trying to get a job - but you should go get a life!

I was watching my local news this am, and people are not getting the right amount on there stimulus checks. this couple was expecting 1200, instead they only received 800.00. boy, I am still unemployed and I guess I wont be getting my 600.00 like I thought. please pass h.r. 5749!

I made 1200. dollars last year! I am 42 and have worked my whole life! On average I make about 50,000 a year. But not last year. I don't even qualify for the stimulis money. Unemployment gone no stimulis money and moved back in with my father. Just having a great time! NOT! Even my union has no program to help in these times. I noticed the open congress site will not come up anymore. The front page came up but no comments. Anyway, there is an article on the front page that states that congress wants to attach the UI extensions onto the war spending bill but are not very enthusiastic. I call for my last check tommorrow. With the cost of gas and food the numbers are much worse since they gave out the last extensions three years ago.

Unemployed since October 2007 -- Hundreds of resumes sent out with no response. Doors are continously closing on my face. This situation is hitting the very core of the American Family... desintegrating because of this! The focus needs to be NOW -- much damage has already been done but the attention needs to be turned around and save some families from total disaster!! Over Syndrome
I never thought I would see this happen. Sending out resumes over and over only to hear, " Your over qualified. Or, "this job requires a lot of Overtime" when what they are really trying to say is "your over 65, over grey, and over weight."
Now, I find myself without a job, Over extending my unemployment and not yet Over the hump to where I can collect a full Social Security Benefit.

How long does it take for the Government to make a decision to pass an EMERGENCY Unemployment extension. "Emergency" to me, has always meant NOW, IMMEDIATELY, TODAY - Not to sit back and wait for the "fire" to get bigger and larger. I can only say a prayer that the extension is passed and for the many THOUSANDS & THOUSANDS that struggle everyday to make what little we have left to feed our families, put a roof over our heads, and put gas in cars.

While I am in favor of passing the proposed emergency unemployment act, it concerns me that comments like yours, which are incorrect and misleading, will hurt the credibility of the rest of us who understand and try to correctly articulate the case for unemployment extension. While it is a fact that EMPLOYERS pay into their state funds (which are state-federal initiatives) each state is different with respect to what it withholds from EMPLOYEE paychecks. Most states do no require that employees pay into the fund. It is my understanding that with the excepton Alaska and NJ, employees are not required to pay into the fund. In other other states it is an employer's option as to whether the cost is shared with the employee. Perhaps you live in NJ and don't know that the laws are different from state to state. I would advise everyone to check out the facts before they state them as such.

I for am consumed with searching every available website to find out what the status is regarding HR 5749, as I am sure millions are as well. As I sit here - unemployed, with all my unemployment benefits exhausted. I hope that Bush had a wonderful, fabulous time at his daughters weddings - as the rest of the millions unemployed try to put a gallon a gas in our car at $4.00 a gallon, with milk at $4.00 a gallon as well. I can barely afford paper products and laundry aids, let along putting some real food on the table. I can not even imagine as to what does through BUSH's head as to why he has not signed this bills, allowing us to have the meager daily life needs. Our lives in on HOLD until BUSH decides to sign that bill. My gosh - how does it take to realize the American people are in dire straights.
