This was not a tax. It was an unconstitutional taking of money from the coal companies that were struggling in the 80's and 90's. This government does not debate the fact that this was an unconstitutional taking. If this was oil companies that were illegally taxed, then I'm sure they would be compensated.

How scary is it that the government could collect money in an unconstitutional manner, and then when called on it, still refuse to repay it?

It is extremely unfair of the government to collect an unconstitutional tax and then refuse to refund the money. The federal government should not be able to take money from companies at will, leaving businesses with no recourse for recovering their losses.

The government should not be able to take money, call it a tax, and then be allowed to keep the money after the "tax" is declared unconstitutional.

The coal companies were even forced to pay penalties and interest if they failed to pay this unconstitutional tax.

How can the government justify collecting an unconstitutional tax and then not refunding it? Would any of us want that precedent set? I know I do not.

I cannot understand why anyone would be opposed to a bill that refunds money that the government illegally took. People that are against this bill need to consider how they would feel if the government illegally taxed them. This is not about coal; this is about our government being held accountable

What reasons would the government possibly have NOT to refund an unconstitutional tax? If money was collected in such a manner, it should be refunded.

I operated a small coal company during the 90's. We were barely a breakeven operation. It makes me sick that the government can illegally take money out of my business and not pay me back. I'm not a big coal company who can make up this later. I provided jobs for 50 employees for over 10 years and have nothing to show for it. It has been implied that I should have known that the tax was unconstitutional. When people pay their taxes, they always assume that the government could not tax them illegally. If we cannot assume this, then everyone needs to file a claim against the IRS every time they pay a tax just incase the tax is not constitutional.

I believe that some of the Big Coal companies have been taken care of while the small companies that this bill would help heal have gotten a raw deal.

I can't believe the government would profit by instituting an unconstitutional tax and not refunding it.

This bill provides the government with an opportunity to correct an injustice and to serve the public at large by assisting an industry that provides half of the Nation's electrical energy needs.

This cannot go uncorrected. The government must return these funds to the rightful owners. If the circumstances were reversed, there certainly would not be a debate about it.

Our government can't just take money from businesses and then refuse to refund it. This is so unfair.
