H.R. 303, The Retired Pay Restoration Act (23 comments ↓ | 3 wiki edits)
H.R. 303 would amend title 10, United States Code, to permit additional retired members of the Armed Forces who have a service-connected disability to receive both disability compensation from the Department of Veterans Affairs for their disability and either retired pay by reason of their years of military service or Combat-Related Special Compensation and to eliminate the phase-in period under current law with respect to such concurrent receipt.

January 17, 2009, 3:04pm (report abuse)My husband served 24 years in the AirForce. Today, he got his award letter of 20 percent. The way we read it, he will have it taken out of his military retirement check. Is this correct? If so, what a terrible thing. He is paying for his own dissability. We know folks that did not retire from the military that are getting there full checks. This is so unfair. Please tell me if I am understanding this. Thanks,SCJ

January 28, 2009, 1:04pm (report abuse)I served in the Navy for 30 years. When I retired I was rated at 30 percent disability. Every penny of my disability compensation is subtracted from my retirement. I think it is outrageous that I pay my own disability. If I had gotten out and retired from another government job I would have my disability and my retirement. Why am I a second class citizen because I retired from the Armed Forces?

February 5, 2009, 9:43am (report abuse)We were told that if we get hurt and become disabled, then we will get disability pay.
It's typical of our government to pull a bait and switch at times of their choosing. Anyone who votes against this issue must condone the government in their decision to short change the very people that ensured they could conduct themselve as they see fit.
Its appalling to think people feel that veterans are asking for a handout, or even a "bailout". Our govenment is giving away billions of dollars to comapanies with little or no restrictions. Those same companies are using that money to purchase executive jets, schedule company "get aways" to Las Vegas, and award millions of dollars in bonuses to executives that ran their companies into the ground.
And yet, here we still are. Waiting and fighting for years to just get what was promised to us. The citizens of this nation still vote against veterans with a seemingly "how dare them" attitude.

February 20, 2009, 2:08pm (report abuse)After reading H.R.333 I agree that it is a better fix than H.R.303. I shift my support from H.R. 303 to H.R.333. My reason is I think H.R. 333 is more specific for meeting our needs.

I believe retired veterans shouldnt be forced to, in essence have to pay their own disability.This is just like the govt. leave everything really vague and easy to manipulate for their own advantages. One would think there would be a line drawn in the sand somewhere that would keep them from trying to screw over veterans. I mean for the sacrifices made isnt the govt. already maipulated and abused us enough already. Now fix the pay plan that you all set up incorrectly in the first place and start to help and appreciate veterans rather than try to nickle and dime us to death.

March 19, 2009, 10:05am (report abuse)This h.r.303 will be law by January 2010. Only, Chapter 61 retirees will less than 20 years of service and 50% service connected disability will get their retired check.

I have 30 years AD, USMC and have a 40% disability. I pay my disability out of my retirement. Why should anyone have to pay their own disability??

May 25, 2009, 11:48am (report abuse)I have been Medically retired for 11 years now..I was retired as an E-7 with 16 years of active service. I have always consider it a crime that was put upon me to serve so long and not receive my full 50% retirement due to me..I was recently given 60% by the V.A. however, I like many others have been paying for either my retirement or my disabilities...This to me has been a huge in justice for all my service I gave to this country. This by the way is the first time I've spoke on this, and I hope both laws are passed on behave of all veterans who serve and gave for this country. I thank our new President for what he will do and pass both laws for all of us. It is about time a "President" went into action for the veterans. Semper Fi

May 29, 2009, 8:38pm (report abuse)I’ve been in the Army from 1972 to 2007. I was medically discharge at 30% with 10.5 years active and the rest in reserve time. I’m VA rated at 70% now. So my retirement check from the Army is about $1500.00 a month but after they take out for SBP and the VA I get $17.00 for retirement. If I had retired from some where else I’d get my VA disability check and a full retirement check. I think it’s outrageous that I have to pay for my own disability. Why are all my years of service to my country worth only $17.00. We earned and deserve our retirement why are we penalized.

May 31, 2009, 10:52am (report abuse)I voluntarily separated from the Air Force after 7.5 years of service under the VSIP program, meaning I was given a small buyout or incentive to leave to help the Air Force with reduction in force requirements...and in essence forfit my potential retirement. I also recieved a 40% disability rating, but don't see a penny of it until my incentive is repaid in full. Would House bill (H.R. 303) correct this situation as well? It is outrageous that a I'm forced to pay back my separation pay before being compensated for a 40% disability.

The Govt. can give/vote on their own pay raises and give tons of bucks to "bail out" companies that cannot be successful on their own but those who gave so much to defend this great country are an after thought? Get your priorities right, Govt employies. As elected leaders, we (taxpayers) pay for you to make decisions/laws on our behalf, to run our country. The way things are going, we may not have a country for long. Vote on this bill! Make it right for those who have made sacrifices in their health and even their families have given up much for us to do so.

August 19, 2009, 12:27pm (report abuse)I retired from the military Aug 17th 2009, with 40% disability.During the retirement brief we retirees with disability, was told that our disability pay for us well be taken from our retirement check to pay us for our disability.
Q: Why is there not 2 seperate checks
1. Disability and
2. retirement

retired pay & veterans' disability compensation...". HR 302 seems to cover my situation better. If I am wrong, please inform me. Thanks.

August 27, 2009, 3:16pm (report abuse)HR 333 states that above MPT, the fit that may be best for you would be HR 303. I personally don't understand the difference except that HR 333 states service related disability rating less then 50%. I don't understand why all persons who retire with a disability don't recieve full 2 checks, one for the retired pay, one for the disabilty?

August 27, 2009, 9:34pm (report abuse)I am in the same boat as all of you I do not think this is right, I am retired 22 1/2 years active duty and 40% disabled.. I want this to end NOW and I want to be back paid in one payment and it should be pre taxed and I want it now.. Why did I Sacafice all this time serving our nation Not making a better life for my wife and myself.. Just to be screwed over for the rest of my life by paying from my own retirement pay that is owed to me/us I did not ask for this disability while I was serving my Nation...

September 16, 2009, 11:06pm (report abuse)I do not see why a E5 or below who only served 4 years of active service can collect VA disability at any disability percentage and get paid the full amount of that percentage.
I served 21 years in the Marine Corps just to get 50 percent of my retire pay, then since Im 40 percent VA disabled it then offsets my retirement pay. I don't really care if the VA pay is tax free or not but I and many others who have retired can barely make ends meat with the income we get. We served our country over seas just to come back to have to fight for the benefits that should be entitled to us in full. A Sgt with 4 years in and rated at 60% VA disabled makes more then me who has served 21 years and that is totally unfair and most of all unjust!!!!!

October 4, 2009, 12:13pm (report abuse)I have been retired since 1988 and have been fighting with the VA for every bit of % they have given me and then taken back. When i left for duty i was very healthy after doing my job for 22 yrs in building now found out to be a hazzard to peoples health (non military are people i think) i have all kinds of lung problems with one lung removed. So i feel i have earned the right to my military retirement i was promised with out deduction plus the VA disibility. All these unpassed bills sitting on desks do not help us after we have done our jobs as we promised to do when we took our oath. Members in Goverenment took an oath also I think they need to go back and read it again and act accordingly!!!!!!!!!

October 14, 2009, 11:05pm (report abuse)I thought all this was taken care of, I thought we were getting full retirement and disablity checks. I don't know it was still being off set. Where can I find info on what my full retirement pay should be. This stuff is so confusing to me, I don't know how to keep up. I got a increase in my retirement pay over a year ago and some confusing letter. I was just happy to get it, didn't realize I wasn't getting the whole thing and/or it was coming from my retirement. I had thought I would be getting the same amount for retirement and disability, but my retirement pay is about $1000 less than my disability pay. Where can I go an read how to figure this whole mess out....the simple way?

October 27, 2009, 8:49pm (report abuse)Additionally, for the first time ever the White House has included a concurrent receipt proposal in their Budget Resolution. The administration’s proposal would phase in eligibility for new recipients over five years. The first three years opens CRDP eligibility to the more severely disabled Chapter 61 retirees with less than 20 years of service. The remaining two years of this phase-in extends CRDP to Chapter 61 retirees, regardless of years of service, with a VA rating of less than 50%. The White House proposal, although included in the House version of the FY2010 defense authorization bill (H.R. 2647), failed to survive conference and was stripped from next year’s defense bill.
