I hope it passes. Non violent felons
are labeled and put on the same list as the mass murderer. And that is not right. I'm glad this problem is being looked at again and has a possibility of getting passed into law.

I feel as if I have to pay my debt to society for the rest of my life. I am not hired for jobs because I have to answer "Yes" have I ever been convicted of a felony. I hope this passes now, and not in another two years from when Mr. Rangle first introduced this in 2005.

This bill also alows for people that have looked at violent material that is sexual in manner towards children as this is a federal crime as well while I believe that people deserve a second chance we also have to look at all the people that this bill will alow out. Looking at pics is not a violent crime, but could lead to one in the future that would not be considered a federal crime, but a state crime.

If Rangel can't pull this one through the process, i don't think anyone can. The other bill, HR 1593 won't do didley for people with an education wanting to get a good job. What employer would hire someone with a criminal background unless all they were doing was washing the floor? Alas, i'm afraid, no one cares...

crimson, if you read the bill in its entirety, you will see that not only does the offender have to meet many pre-requisites, but the petition MUST ALSO MUST BE APPROVED BY A JUDGE OR OTHER AUTHORITY. You can be sure if the offender was invloved in child anything, he/ she will never be approved for expungement.
Advocate for many reasons
Finding gainful employment as a convicted felon – irrespective of the nature of the crime - is near impossible, and continues to be long after debts to society have been paid. In substance, every convicted felon faces a life sentence with respect to employment, making leading a normal life an insurmountable task.
This Bill would, among other benefits would:
1. Provide hope, dignity, and motivation where there is none
2. Significantly reduce recidivism.
3. Reduce taxpayer burdens and government expenditures by:
3a. Reducing the number of felons seeking social services (welfare)
3b. Reducing the number of felons seeking government sponsored healthcare
3c. Reducing the costs associated with housing inmates
4. Reduce crime as felons would be able to find legal means of earning an income
5. Reduce unemployment
6. Help break the vicious cycle of crime and welfare as a way of life in certain communities.

I can't urge this enough, this bill is exremely reasonable and well written.They hand out felonies/misdemeanors for very petty and unserious crimes.These convictions are serious labels and restrict any means of real life.Many people make mistakes, some get caught and others don't.You'd be surprised at what B.S.could get you a conviction with such serious consequences.If you read the bill you will see that only non-violent crimes would be eligible and if they screwed up again the expungement gets reversed.This could bring some great changes and relieve some very congested issues (i.e.,budget,prisons,welfare,unemployment,etc.)Please support this bill and urge others to do so!

I hope everyone gets together and writes a letter or do whatever necessary to get this bill passed. The system is messed up because a conviction leaves a mark on your name for life. This Bill keeps stalling in the Judiciary Committee. It appears that our "friends" in Congress are more concerned about granting amnesty (Pardons)to Mexicans and other enemies of America who by the way have committed numerous Felonies than helping their fellow constituents .
It's a shame that there is no remedy to erase or get e Certificate of Rehabilitation for a non-violent federal conviction as it exist on the States level. So contact every member of the House Judiciary Committee and tell then to move this Bill and write letters to every Congressman/woman and U.S. Senator and tell them to do the same.
Don't be discouraged thought as in almost every State all voting rights have been restored except in Virginia if I'm correct.
We have to push Congress to pass this HR 623 and not to set it aside each time.
Having a lifetime criminal record on file with all the resulting liabilities is a cruel punishment and must be changed.

I feel this bill is a very good first step in reducing recidivism. However, "Any crime" which happens to be a "first offense" should have an opportunity (if that person has proved rehabilitation) to get that record expunged. All ex-offenders need to should be able to feed their families. Should a person who was convicted of a Robbery and recieved 2 to 6 years in effect "actually" be sentenced to a "LIFE" sentence?
Is congressman Rangel saying that an ex-violent offender should not have a fear chance for employment? God Forbid. Why must there always be a "boogie man" when it comes to giving mostly black men a second chance?

I have paid my dues to society and then some. Having recently graduated from a university with a BS degree, I am learning quickly by answering "yes" to the dreaded convicted question, my application gets tossed, recruiter changes their tune, or interview stops.
If this bill passes maybe people like me that are trying to better themselves will have that "second chance!"

This is truely a bill who's time has come. Having your chances of a normal life greatly reduced due to a non-violent crime that has been paid for makes no sense. In many cases it increases the strain on public assistance. Additionally, if we truely believe people can change, don't we need to give them a chance to?

I was a rebellious youth and reached out for attention the only way I knew how, when I was very young. Now, I'm a completely different person, if you can see the difference between you at 18 and you at 30, it is no different for me.
But here I am at 30, I still have a job history of only being hired when I lie on my application and fired when I'm figured out. Twice I was not fired when figured out, instead the employer stopped paying me until I simply quit. Now I'm in College going for my Bachelor's and I'm afraid that, even is I can get my record expunged, my juvenile-looking work history will create further employment problems.

It's great that we are finally identifying one of the reasons why individuals recidivate- I counsel the population in question and they are making positive decisions these days but still have a tough time accessing opportunities -
My number one concern about this issue is that, How is it that "White Collar ex-offenders' have a greater chance of securing career opportunities and regain access to financial benefits and all that comes with it - yet, others are barred for Life for their
"Low-Collar offenses"-
Last I checked if someone affected the family structure by selling narcotics and taking money from households are in no means less than when someone causes employees'at major businesses loss of jobs, benefits, savings etc..

TBN, it's not so much about 'White Collar' as it is 'non-violent'.
Many non-violent drug crimes seem to qualify. Though, it will probably be an issue on just what does qualify at the margin.

Now that the Second Chance Act House Bill 1074 has been passed by the Judiciary Committee today August 3,2007 and sent to the House for deliberation let's hope the other more important bill 623 will finally see the day and pass in the Judiciary Committee and eventually become a law.
As for the above poster you have not necessarily lost your right to vote. It depends on your State. Most States except for Virginia and Kentucky do not prevent people convicted of Felonies,whether State of federal, from voting.
Usually the right to vote and to run for office is returned upon either discharge from prison, or upon satisfying the probation requirement.
Write also to as many Congressman/women and Senators asking them to please pass this Bill 623 as on the Federal Level there are no other avenues to have a Certificate of Good Conduct or one of Certificate of Relief from Criminal Disabilities and none at all for expunging a Federal Criminal record.

This bill is a good idea. People are not perfect and make mistakes. Then they grow up or move on and become productive, quality people. Finally, something from the government that rewards GOOD behavior.

This is an excellent bill. It will help to reduce crime, improve the economy and promote education. The unfortunate reality is that ex felons don't have a lobby with a warehouse full of cash to get any attention paid to this bill. We are talking non violent one time offenders, lets show some compasion. Ex felons is the one group in the U.S. that doesn't have a voice. All I have is a prayer that this HR becomes law. it would allow me to get this drug conviction of my back from when I was 18, which by the way is not old enough to buy alcohol or gamble but certainly old enough to punished for the REST OF YOUR LIFE through economic means for a indescretion commited at that age. I pray and hope for HR 623 but know it next to impossible for this to become law in the next 10 years.
623 will change my life
Ten years ago as a 20 year-old kid I became a convicted felon because of a drug conviction. In the last 10 years I have graduated from a top college with honors, married an attorney and had 3 children. I own a home, pay taxes and live as a law-abiding citizen. I had my civil rights restored years ago so legally I can vote, serve on a jury and obtain a professional license. In reality, as soon as I disclose I am a convicted felon the door is shut in my face. I cannot obtain professional employment. I can't even volunteer at my child's school because now they require background checks. Thank God I have a supportive family. I can't even imagine how difficult and hopeless it is for people who don't have any support. Unfortunately, when we are young and dumb we don't realize how our actions are going to effect the rest of our lives. No matter how much I accomplish in my life I cannot overshadow the stigma of being a convicted felon.

Living the nightmare
My partner has a federal conviction and this bill is a ray of hope not only for them but for me as well. The federal government destroyed 35 years of good employement and deeds with the single conviction. I plan on writing to my representatives. This is almost life or death. If this passes, I have hope that someday, we can get back on our feet. Without it, our lives are ruined, financially and emotionally. I used to have respect for the law. This might change my mind, a little. Next we should work on the corrupt FBOP. Guards withhold meds from the sick, they keep food/items intended for inmates for themselves and there is Absolutely, positively, nothing you can do about it. It is a gestapo. I can't even begin to tell you. Please, support this bill, everyone. It could be you... really, it could.

It will allow people like myself too move ahead with their lives and not too be labeled or reminded of their crime every time we apply for a job. People do dumb things at times and for the most part, there is no justification for it. Some of us want a second chance, we owe it too our families,employers and too ourselves. I agree that if this bill passes we will see a slow decline in crime rates as well as incarcerations. Depending on the circumstances, an ex-felon can change and live a productive civil meaningful life. Maybe we should look at the offenders on a case by case basis then made a determination.

Yes, this act would in fact help people who were convicted, railroaded, or forced to plea bargain because of the way the "system" works. This bill has died in the past and will die again. Why? In over a year only 51 comments on this website. It is election time. Write and talk to candidates. Maybe that will work. But this bill does not spend any money. It only helps people get a second chance. What politican wants to help. They only want to spend money. Our lives our over. Marie, as far as being a US citizen is concerned, you are correct -- your life is over. My suggestion? Try to see if it is viable for you to move to another country like, say, Mexico. Learn spanish, denounce your US citizenship and show the Mexican's how hard you want to be a member of their society. I think they are willing to give you the second chance that the US is not. It appears some of us haven't learned from our mistakes, the ones that got us in the position we are in today. Others judged us, however we disagree, and now we use hateful judgements against those trying to help us, such as Congressman Rangel. I guess the true test is in the character, whether a person is truly repentant.

I praise rangel for all he does. And to all of you who are like me and know we are still in a prison without bars go on and never give up. I have watched this go to subcommittee and fail since 2001. Look back you will see. But work even if it is door to door never go back even if you must starve first. we must be peaceful and law abiding for it is the only way. But when you can take no more and know you are at your limit go to washington dc and in a peaceful way show your pain. eventfully the media will see and will show our plight until it is in the minds of congress and the people we are lost to the world.

Hey NOPE- we are talking about NON-Violent crimes, not rapists and murders. People like you and me, just the ones that have been caught. I'm sure you've made a stupid mistake in your past. An addict should get help, not 10-15 years and a life-sentence of poverty. The ignorance of people like you are what will stop this bill from getting passed, leaving more families on public assistance and more second time offenders. Without a decent job to support your family, it is hard not to want to turn back to the streets out of pure desperation. This act is beneficial to everyone, not just the criminals. The money we'll save on the lower number of welfare recipients can be used for MANY other things, including helping the community your kids go to school in! Read more into the bill. There is no down fall, and no rapists or murders on the street.

yes, i can finish my rantings.for 3 years i lived in a barrio outside of la paz mexico.i had a few good mexican friends,but found an underlying bias against gringoes.theyre still mad about the mex-amer war.as for holding property there in a mexican corporation;any time youhave to deal with the mexican legal system,you are at a disadvantage.remember they're using the napoleanic code,ie there is a preupposition of guilt.this also applies to civil law.also since you need to apply for a new (permanent residence) visa every year there's too much chance of criminal history coming to light.it.s just too much of a hassle.other places you could consider would be the dominican republic or panama where the almost valueless us dollar is legal tender.where ever you decide to go you should do it asap.big brother is expanding his computer file capabilities.soon the door will be closed unless hr 623 can get passed.if that happens the door will be open tomany other places...ken

Even as a former prosecutor I cant , I am praying for this bill to pass. It is so important to keep our society functioning.
I had a client in private practice who had been convicted of federal theft of property valued at a mere $200 in 1992. He has never been arrested for anything else in his life. He has never had any unpaid traffic fines, had held long term employment (for the federal governemnt no less), paid taxes, and contributed to the economic flow of society. After pleading guilty, the man paid immediate restitution, was placed on probation and was even allowed to keep his job for the federal government. Now, 16 years later (and after layoffs by the feds), he cant find a job, cant vote, cant go hunting with his family, etc. This is the perfect example of someone who broke the law, was punished accordingly, paid his debt and should be able to move on with his life.

The only practical way to get this Bill move forward is to mobilize by the hundreds and go to Washington,D.C and demonstrate in front of the Judiciary Committee, the entire Congress and the U.S. Senate.
We will have to organize with the help of Charles Benninghoff and just take off one day when the Congress in in Session with banners and speak loud and clear to those insensitive dictators and express our grievances.
Millions of illegal aliens did it, even though they had No rights, we should be able to do it too otherwise this Bill will take decades to resolve.
Those who are not willing to take one day off then they will have only themselves to blame! Wake up.

I am a Mother of a violent-crime offender,my question is if it is not intended to help the violent- crime offenders. What will happen to them when they are finally released from prison. NO EDUCATION while they incarcerated, what is the point of releasing that person.Sounds like they are setting up a particular set of rules for people who need it the most. I was convicted of a drug crime in 1982 and served 5 months in a federal. Since being released, I have obtained a Master's degree and dedicated my life to helping others. I have always indicated my conviction on job applications, but these jobs have been obtained through friends . But more recently as I have applied for jobs with schools and hospitals, the door is closed in my face.

Write the members of the House Judiciary Subcommittee on Crime, Terror and Homeland Security. H.R. 623 is currently with that committee for review, but it will not get any movement unless people urge their representatives to support it. Go to this website: http://www.govtrack.us/congress/committee.xpd?id=HSJU. If any of these people are in your state, fax or call them. They will respond to your request. ALso,contact the representatives for your state and ask them to cosponsor the bill. Now is a good time since the Senate just passed another Second Chance Act aimed at reducing recidivism.

Rich and powerful people already have access to a second chance, or third or fourth. If you have enough influence, you can receive a pretrial adjudication - and not be charged for a crime if you comply with a probationary sentence. However, that option is not available for most people - and the result is a lifetime of being labelled and unable to redeem themselves.

Why isn't this bill moving forward? Its a good law and will give people a chance to be working and contributing to this country. It will actually reduce crime because people who might have made one mistake, a nonviolent mistake, can go to work and support themselves instead of needing help all the time or becoming desparate.

I see H.R 1593 Second Chance Act passed this year but there is no mention of Federal Expundgement. Comparable criminal offenses whether at the State or Federal level you would think would have like similar punish consequences, and most research show that they do.
However at the State level, a person has the opportunity to petition to have his/her criminal record expunged; there is no avenue at the Federal to do the same. Surely inequity exists; although different systems, same or like offense, same Country, same demographics, appear unjust and all indicators say there is no equity in justice in parallel systems designed primarily to rehabilitate the offender.

The equity (or inequity) situation is a good point. Barriers to becoming fully rehabilitated exist for federal offenders, regardless of how much time has passed or how relatively small the offense. State offenders at least have some incentive to rebuild their lives and seek employment, but the person with a federal conviction has to jump a hurdle that is impossible.

If you think a conviction just happens to so-called "bad" people then think again...it could happen to anybody just like that. errors happen in court and sometimes people get railroaded or get convicted for acting in selfdefense. it could happen to you. everybody needs this bill. it can only help, not hurt anyone.

This is just sensible, and way overdue. The judicial system isn't respected in this country because it is entirely uneven. The powerful and rich get ways around convictions on their records, the majority of people branded with any kind of conviction are either poor or middle class. It's Not for murderers and multimillion dollar embezzlers, the second chance act is for people who have suffered excessively from a much earlier mistake, or who may have even been falsely convicted.

EEBRASWELL, Rest assured that people who do get convicted of a crime are being punished. In addition to their sentence, they face many years of being disenfranchised. This bill just offers hope to good people who want to constructively rebuild their lives and not be literally punished for the rest of their lives, along with their families. These people are elected by us and they need to listen to what we want done. Don't be afraid to let them know. I made some mistakes when i was younger and i did my time for it. After release it has been increasingly more difficult for me to work. I'm well educated but the brand of "Felon" is more than enough to put employers off. Let me tell you, the punishment of time spent is more than you could ever know. Unless you have been there, you couldn't possibly know. It impacts you, your family, everyone around you. It disenfranchises you from the society as a whole. If we as felons have paid our debt to society, I would like to believe that we deserve to be treated as full members of society again. Sadly, this is not true, I am a member of a group that is permanently branded. When you leave prison the joke is always "we will see you when you come back" and the worst part is there is far too much truth to that joke. Please call and contact your representatives, the vast majority of felons are convicted for minor drug offenses and white collar crimes. Give us a chance.

Well doing nothing will leave you stuck in limbo anyway so you might as well do what ever you can. I cant storm the halls of the capitol because I can't just go to Washington with a family here a thousand miles away but I will keep on trying to send messages to my representatives, and at least some of them will hoepfully listen to the people.

Some of these comments are from people who committed a minor crime over 25 years ago, but they are still being punished for a lifetime. There's no reason for it to be this way. HR623 is a sane way to begin solving some of our problems with inequalities in the justice system, recidivism and a cycle of joblessness and poverty.

If 1 in 100 Americans are in jail or on parole, then I wonder how many are in "no mans land" in between with an old conviction they can't rise above. I'll bet it's a pretty high number. What would happen if just half of those people could get back to being a full American, with good jobs and a way to support their families. Why would anybody not want something good like this to happen.

i too have aproblem its a misdemenor assault 1day in jail no fine happend 1995 an now just showed up on a gun purhace 2008 local courts never turned in an according to my judge;who is ahouse rep now said it would never effect my 2 nd amendment rights an now im in trouble with the feds this law will be of great help for some of us i hope

I think that passing this law would be wonderful. It is nice to finally have some reprive from this ordeal. I am a college graduate and find it hard to get a decent job because my exboyfriend lied to me and got me in trouble.

I agree with this law. Why do you have to be punished for the rest of your life for one mistake that did not hurt anyone else? If you have a conviction of any kind on your record - that's a life sentence! you might as well just give up. I think some people like the idea of permanent punishment, it makes them feel superior, but if you want people to get back to work, or go into the armed forces and support this country, you would also want this bill to pass. It costs nothing, but pays back good things to society.

To Nope, I can't believe how close minded you are. This bill is not aimed to expunge the record of rapists and murders. It is to help first time non violent offenders have a fair shot at getting a decent job. What is your problem. I made a mistake of trusting someone and ended up with a felony. That does not make me a bad person. I have a college degree and graduate tomorrow with an MBA. There are lots of people out there who made a mistake once and are being punished for it for their entire life. I hope no one in your family ever has to face this because they sure wouldn't be able to count on you for support. I heard that Bush signed the bill on April 9th. Don't know what this means yet. Hope it is good though.
