April 26, 2008, 6:38pm (report abuse)This is the real problem for H-1B worker. There is only 140,000 EB-Base visa/year but it has a lot of unused number left every year. On another hand, EB-base visa is backlog to 3,5,7 years.
Even the H-1B CAP increase to 195,000/year, the EB-base Visa number is 140,000/year or less, What will be the final solution for those H-1B works? And how about 29-month OPT students?
This bill make sure 140,000 visa number will be all used for the right workers. So it is great!

April 28, 2008, 12:33pm (report abuse)Yes I agree that wasted Immigrant visa numbers is a real Issue for H1B workers. The USCIS, which is the gov agency responsible for issuing these Visa numbers (a.k.a Green Cards) to EB (Employment Based) applicants, wastes about 20-30K immigrant visas due to their low productivity. Hence even though 140,000 Immigrant visas are mandated by the Congress to be used up every year, not all these visas get used up. This results in a large backlog of applications from people (H1B applicants), who have wait for undetermined periods of time, for the agency to issue them a visa number. The lives of these people have been kept in limbo as there is no accountability. This bill will bring some hope to those folks, who have been waiting and have been paying taxes on their income.
Keep the skills here so that outsourcing is minimized.

I am a registered nurse and have worked really hard to pass all the needed exams to become a registered nurse and to pass the English test, and now me and my family is in uncertain situation because of all these delays, in fact all our life suspended and depends on the outcome of the debates. Besides, I am affraid that my test results may become out-of date due to the delay of my immigration to the USA. So, I will be praying for the success of this bill!!!

April 28, 2008, 4:36pm (report abuse)I have a big doubt.Even if this bill will pass [ lets hope..] USCIS will not able to work to use all of these visa numbers in 1 year..They work very slow and their productivity is very less...so no point of increasing visa numbers only also increase the productivity of USCIS.

They have no intention of turning your H-1B into a green card, then you could compete and negotiate. When your visa expires, they can simply replace you with a new H-1B if the caps are expanded as they've requested.

We thankyou for understanding and helping us in this need.We have come here for a better future and hope in our life.Our hard work and education has shown us this destiny.There is no race or cheap labour here.Why is this partiality going on,Just because we are from developing .I apologize for this comment.its a true question ,a doubt lingering our minds.We have so far missed our main seperations at the time of need,marraiges and many more.Even the Advance parole we have applied for ,we havnt received that too.Its more than 8 months.When we think US we imagined a rewarding life which every immigrant has been imagining and enjoying here.Our kids really don't know the difference between these two countries.We are in a bad nutshell...we are unable to move take drastic decisions.We have had enough of seperations and undergoing many frustrations because of the greencard delay.
We request to pass this and relieve us. I wish this bill helps us all.

could not be granted in last 10 years and went wasted as USCIS could not process them. The result is a big line of legal
immigrants waiting in queue to get their Permanent residency. If the current trend continues, it will probably take another 5-10 years for the
legal immigrants to get Permanent Residency.This is on the top of 4-5 years that we have already been waiting. If these
unused visas could be recaptured, this could definitely help.

This bill is to use all the numbers that were wasted in the last 10 years or so. It bring relief to thousands of families. This is the least that Congress can do to those skilled people who have come to this country leaving behind their home country and families and values with high hopes.

This numbers are approximate. In reality much more fee and little more time may be needed.
Expences go down if use systems optimally. People waiting for more than year just get processed.
4 service centers doesn't have 1000 Io's all over country? Can't employ that many at least with the amount of fee receiving?

July 15, 2008, 1:35pm (report abuse)Its funny how for a country who's foundation lays on "No caste, creed race or sex but the best" has a criteria for entering and getting into naturalization as "Are your from India/China/UK/France/Afgan..etc. and have quota system".
Lets face it if you are good you make it and let the country prosper on a free economy and culture.
This bill will rectify some of the current economic and immigrant issues rather than creating more. Just imagine so many people waiting for Green card and not spending much and saving money for the rainy day, gets their GC. Everyone eventually will put the money back into the system esp buying a house for instance.
Its shear common-sense to support this bill and shear prejudice against certain race not to support it.

American citizenship has never been an entitlement to anyone but existing American citizens. The other commenters who chide the USCIS might do well to remember that they are here as 'guests' and their presence is a privelege, not a right. The opposition to this bill does not propose to change America's already generous immigration program. It simply proposes to not expand it. In a somewhat unstable economy where American workers are being displaced at all levels of the economic scale by immigrant labor, it just doesn't make sense right now. If you don't believe the displacement statement, just look up, 'Nielsen TATA Oldsmar'

Look at EU countries that are opening up to immigration - you can get UK citizenship in as less as 4 years - compared to US citizenship that takes about 11 - 13 years (GC processing years (6 to 8) & 5 additional). Same goes with other EU countries.
Even if this bill passes today, it will take 1.5 to two years to see its effects. Economy is cyclical & will definitely improve by then. Which is why it is important that US needs to be ready to with strong workforce by then.

The problem has been an vastly excessive number of student, exchange and guest-work visas being issued, which neither USCIS nor DoL were capable of processing properly, and which led to excessive applications for green cards. Cut the numbers of student, exchange, and guest-work visas back to reasonable levels of 1K or so of each f these 3 categories in the USA at any one time, and poof, the back-log of green card applications would disappear.

but 140K immigrant visas are too less due to number of dependents, 245i, etc
Add to this the inefficiency of the USCIS which is adding to the frustration.....
This bill is a first step to fix the issue.

2) Who will buy new houses?
3) For every EB-immigrant you loose, you loose 3 american jobs. This is for sure.

September 7, 2008, 9:31am (report abuse)In our county, we are in dire need of registered nurses and almost all hospitals cannot meet the 1:5 ratio requirements without forcing current nurses to work on double shifts. This pose as a safety risk to the patients and to the nurses as well. We need additional licensed nurses. We saw how good these foreign nurses are. Recapturing unused visas will help those waiting in line get a visa and enter the US and help mend the shortage of nurses here in the US.

September 7, 2008, 12:16pm (report abuse)If something is promised then it has to be given, if the System promises certain number of visas and if due to the efficeincy of the system if they fail to process it and keep up the word there has to be a channel to fix and give back those #s otherwise it will set a bad example and it will reflect in other parts of the system where whats is promised might not be delived. So I think it should be given back to hard working immigrants who sacrifice a lot for their American dreams and This move will help the lack luster economy ,subprime. If the Green cards are given Im sure lot of immigrants are looking and willing to start their own which provide and create more jobs for the Americans which will bring more money to the system so i personally feel the immigrants should be given back those #

September 7, 2008, 3:11pm (report abuse)Well in any country, immigration plays a vita role in shaping the economic and cultural performances. A lot of you may concur with me, Diversity is good, specially in times when Global Business has become a key of survival for any big company.
However I am against H1b visa system, all the Indian companies are abusing the H1b visa's, they bring consultants from India, pay them cheap and exploit not only these poor consultants but the companies as well.
All these consultants who declare about 5 year work experience, is a big deceive, they don't have any 5 year experience, it is all a big corporate lie.However, I am in favor of more number of green cards, because of these practices by a few, a lot other people have to suffer.1. We cannot buy homes.
2. Spouses cannot work 3. Personal decisions are on hold.So please I ask all of you, to support the people who have worked very hard in this country and are waiting for their green cards for last 10 years. Please understand and help us.

However I am against the H1b visa, which is abused by Indian companies, we should start an investigation against these companies, their is no real need, but it is artificially fabricated by these companies. I have masters from this country, my wife has a Masters as well, both from Top universities.We paid our due's, paid taxes, have been following the laws, and we want ourselves to get green card to buy a home and build the foundation for our families. Please Help us, to make better future for our kids and for you all.

1.Will NOT add any more new visas.
2.Will NOT bring any new foreign workers to US.
3.Will NOT replace any american from American jobs.
4.will NOT bring down wages of American tech worker.
Bottom line,all it does is change the visa status of a worker who is already in US for past 4 to 8 years and who is already in US.

September 7, 2008, 9:08pm (report abuse)This is a great bill. It helps us retain Doctors, Nurses, Research scientists and other professionals that we need. These people have waited patiently in line for up to 10 yrs, while the do nothign congress has toyed around with the "CIR" issue. They have done everything the correct way and due to Gov't bureaucratic delays, even the allotted visas were not approved. This bill redresses that issue and at this time would give a side benefit of a boost to the housing market, as they buy homes. Alternately, if we kick them out imagine 200K people each leaving with their 200K dollars saved! Why?
Imagine the loss of skills, the loss of taxes paid, consumption etc etc. Remember these are very desirable responsible citizens.
We must pass HR5882 now.

I have some skilled professional working in my project team, who are stuck in this limbo for a long time, they work hard and all they aspire for is a better life for themselves and for their families. Lets reward them for once, and value their skills and their hard work that has made Unites States a Strong country of business and technology.

Has anyone who's an American tried to find an IT job lately? Most are taken by foreign workers. How is that good for America?

"EB(Employment Based) bill is for people who already HAVE a JOB in the US and not taking any new american Jobs.
Unemployment being highest level in 5 years doesn't mean there are no Jobs - its because people want Job based on
1. Work Type
2. Location, Location and Location.
Not many people want to travel to different state in order to work (other than foreign workers) they like to find Job where they live and if there are no Jobs near by they don't try. Search on Monster.com or Dice.com there are lot of IT Job openings.

Thank you senator Lofgren for sponsoring this bill. If the US delays in reforming its immigration policies, Canada, Australia and the other EU countries are seizing this opportunity to attract highly skilled immigrants. This is a land of immigrants and hope our American dream comes true.

Had my Master degree in US, working in a US manufacture company, helping US competing with rest of the world (Japan, China, Europe) however instead of helping me the immigration system breaks my heart by keeping so many obstacles on my way of becoming a citizen. Really hope this bill can pass to ease my frustration. Besides my wife and I have at lease 50k in cash would will buy a house if we are sured to stay here permanently. I guess many skilled legal immig. will do the same thing once they get GC.

Actually, "Unemployment at the highest level in 5 years" DOES mean there aren't any jobs. I look at Dice and Monster all the time since I'm a CIO at my company.
What do we tell the new graduates in Computer Science. Too bad we gave you job to someone from India cause that's what's happening...

Laws have already been passed, reform is not what's needed, enforcements of exsisting laws is needed. Then focuss on helping honest hard working people to enter the country legally.

why do we need immigrants for innovation? We have plenty of innovation with the people already here. The milk and honey bus is full folks, please go home and come back another day when the milk is flowing and the honey is plentiful because right now it's all dried up. Where are the pensions, the 401's, the age 65 retirements? They are all gone to taxes, politicians, democratic handouts, wars, credit malfunctions.
You are only part of the problem but please go home anyway and come back another day.

That is not justification to displace your host, call him an idiot, and take his job. Your few years does not outweigh the generations that laid the foundation of this country. Learn from America, go back home, and emulate us, but do not call us idiots and displace us.
Come back when times are better, please. The liberal Visa handouts have been abused for far too long.

September 10, 2008, 9:17am (report abuse)2.Most dont invest, buy homes, start businesses for the same insecurity, and would goback to their "disfunct countries", so giving them status is good for the economy as they will buy homes, invest here, and produce more jobs for American People. How do I know? I employ some of native born people.
3.Legal immigration is much bigger and complex system than you can ever possibly understand with your simplistic assumptions. Its flawed and broken. Its easier to be illegal in this country than try for legal residency. How do I know? With a Masters degree from a prestigious US institution it took 5 years for me to understand...go figure

I will stay here to make my life better, no matter how anxious and insecure you become, so going away and coming back when times are better are for uneducated, incompetetive, lazy people..I promise to stand up and work my ass off to make tons of money and pay taxes and hire more American people, all legally, however difficult it is, providing an example to my brown kids on how hard they make it here, so they grow up and kick everyones ass and be super good, like you see at the apelling bee's.
5.You will understand the pain if you have a family and some system forbade your children or spouse to see you, join you, and even if they do, forbids them to work for another 10 years, inspite of being qualified, smart and competetive, the founding qualities of america that made it what it is in the first place.
I rest my case, till your next misinformed comment..

We need to employ Americans first before we facilitate a system that allows easier access to American jobs for foreigners.Congress continues to forget who they work for when they submit this legislation. Americans here are suffering and need to have access to jobs first. After all they are the "people" the constitution speaks about serving.Ther constitution does not grant foreigners who want to enter the country and displace American workers the right to pursue life, liberty and happiness. But that right is afforded to American citizens.

If they are currently on a H1B visa then they usually have to stay at the position they were hired for or go home. Once these 550,000 green cards are issued then the holders will be able to leave their positions and complete with Americans even more directly for jobs. How is this good for Americans looking for work? Doesn't it make it even harder for Americans as now they have 550,000 more people to compete with?

My response:
1) American workers currently unemployed because of foreign workers will pay into Social Security when you leave. It's no secret that one doesn't pay Social Security taxes when one is out looking for a job that was taken by cheap foreign labor.
2) See my response to #1 above. When the hundreds of thousands of American high tech workers return to the work force, they will buy the new houses.
3) I shouldn't even respond to this one, because the premise is total BS. Each H1B generates 3 American jobs??? Total BS. You need to quit drinking the Kool-Aid. Rather, for every H1B that gets sent back home, it will create multiple jobs for Americans hired to rewrite the awful code that most H1Bs are known for.
