H.R. 3079 would amend the Joint Resolution Approving the Covenant to Establish a Commonwealth of the Northern Mariana Islands.
Detailed Summary
<b>Title I: Northern Mariana Islands Immigration, Security, and Labor Act</b> - Northern Mariana Islands Immigration, Security, and Labor Act - (Sec. 103) Extends U.S. immigration laws, as defined by the Immigration and Nationality Act, to the Commonwealth of the Northern Mariana Islands (CNMI), subject to a transition period through December 31, 2013.
Sets forth provisions respecting: (1) numerical limitations for nonimmigrant workers (parallel provisions for Guam and the CNMI); (2) nonimmigrant investors and nonimmigrant workers; and (3) removal.
Directs the Secretary of the Interior to report to Congress respecting nonresident guestworkers in the CNMI.
Amends the Immigration and Nationality Act to provide for CNMI nonimmigrant visitor visa waivers (as currently provided for Guam) for stays of up to 45 days (current law provides for 15-day stays) in Guam or the CNMI. Directs the Secretary of Homeland Security (Secretary) to monitor such admissions and suspend the entry of nationals from a country whose nationals have created an unacceptable number of program violations or pose security or law enforcement risks.
Provides that a person: (1) seeking U.S. entry from the CNMI shall be processed under existing immigration authority regarding entry from Guam, Puerto Rico, and the U.S. Virgin Islands; and (2) denied admission shall be immediately removed.
Authorizes: (1) additional countries to be added to such visa waiver program; (2) creation of additional Guam or CNMI-only nonimmigrant visas; and (3) the Attorney General, the Secretary, and the Secretary of Labor to establish CNMI immigration operations offices.
Directs the President and the Government Accountability Office (GAO) to report to Congress respecting the transition program. Authorizes the Governor of CNMI to report to the President respecting the program.
States that the CNMI government shall: (1) not permit an increase in the number of alien workers in the CNMI as of the date of enactment of this Act; and (2) administer its non-refoulement protection program in accordance with its September 2003 agreement with the Department of the Interior.
Exempts hospitals in Guam, the CNMI, and the U.S. Virgin Islands from certain nurse admissions requirements.
(Sec. 104) Authorizes appropriations.
<b>Title II: Northern Mariana Islands Delegate Act - </b>Northern Mariana Islands Delegate Act - (Sec. 202) States that: (1) the Commonwealth of the Northern Mariana Islands shall be represented in the U.S. Congress by the Resident Representative to the United States (authorized by the Covenant to Establish a Commonwealth of the Northern Mariana Islands in Political Union With the United States of America); and (2) the Resident Representative shall be a nonvoting Delegate to the House of Representatives and elected as provided for by this Act.

The plan to freeze the next wage hike would mean disaster for those minimum wage earners. I understand that most of us, can't decide in moving on and leave CNMI because of the pending outcome of the federalization bill H.R. 3079 [S. 2483]. For the meantime, think ahead. Visit "WorkAbroad.Ph" where there are available job offers elsewhere like Singapore, Malaysia, Dubai etc. Free food, free housing and free transportation are among the benefits. Don't waste your vacation time in the Philippines, instead utilize it wisely by visiting licensed recruitment companies. Your work experience abroad will help a lot.

If we are to stop depending on outside workforce, then the CNMI must be in line with the minimum wage of the mainland U.S. Then we will have all those people (Locals) that left their homeland come back and contribute to the economy. That way employers can save on application fees, bonding and all other fees that are impose. We don't need to federalize our borders here. This fiasco is all about labor and working conditions and benifits, why can't we focus on that! Our Immigration system have no problems.

March 17, 2008, 7:14pm (report abuse)I was awarded $3,000.00 from my 1991 labor case against my employer. The amount was never handed to me by the Labor Department, gone with the wind. Good thing that there was transfer relief and until now I am here in the CNMI and still working. Unclaimed or forgotten labor cases awards? Perhaps ineffective Labor Department policies is to blame. I read newspaper everyday and I still hear sad stories about labor cases that I can always heartily relate. Poor contract/non-resident workers, welcome to the group.

Big account that i have is different government agencies through Purchase Orders. The problem right now is the Government is broke it took me 6 months or more to collect from them. Once federal took over, do you think it will give money to the CNMI so that I can collect faster? I also noticed that local businessmen tends to collect easier than of those alien businessmen. Is there a discrimination going on in Finance Dept. & Treasury?

Thank you for your concern. I suffered a lot when I got this labor case before. Not to mention, days without food and shelter. My ex-Boss was a friend of a then high raking labor official. My first request for transfer was thrown into the trash can by this official in his office and I was told to go back to where I came from because he won't give me any chance to get other employer. A good Labor investigator handled the case and won it for us with a transfer privilege. Unfortunately, the cash awards were not collected even we hired an attorney. Life must go on then, and I just concentrated on my job just like the other non-resident workers who do not have voice nor the courage to fight the system. To all low hearted Godly individuals and to you Nate, bless your hearts.

It is lucky the here you get, FREE: Medical, Food, Housing, Transportation, Welfare for U.S. born children here and to top it off, a salary which you will not find it in the Philippines, China or other countries besides the U.S. So where is the injustice there? The injustice I see here is the suffering of U.S. citizen employers that are trying to meet ends meet just to survive and keep their businesses running so that employees could have their benifits. Also to contrast between U.S. Citizen employees and Non-U.S., who has more benifits? You do the math!

It is just right that an employer follows what is written in the contract as the contract workers do their part by doing the job that is asked of them. Try to ask the contract workers first if everybody is really getting the benefits that you are talking about.

Yes, minimum wage went up to $3.55 but non-resident workers salaries will go to "new" or "increased" employers "CHARGERS", staff housing fee and food. Not to mention, cutdown working hours.
