This bill needs to pass because currently a first time felon with no criminal history receives a standard mandatory minimum harsh sentence with no variance or downward departure. The courts are restricted and can not go below the mandatory minimum sentence regardless of the offenders criminal history or PSI report....

H.R. 2934 would amend title 18, United States Code, to prevent unjust and irrational criminal punishments.

Detailed Summary

Common Sense in Sentencing Act of 2009 - Amends the federal criminal code to authorize a federal court to impose a sentence below a statutory minimum if necessary to avoid violating federal provisions prescribing factors courts must consider in imposing a sentence.

Status of the Legislation

Latest Major Action: 7/14/2009: House committee/subcommittee actions. Status: Subcommittee Hearings Held.

Points in Favor

(Log in to edit the wiki and be the first to show why the bill should pass!)
