I agree. I left the acute care setting due to the long hours and mandatory overtime. Everything that Ms. Pool said is sad but TRUE. Everyone is put at danger, including the general public. A patient in a hospital is alresy sicker than average (because you have to be half dead to meet inpatient criteria) so to add to the patient being more at risk because the nurse is tired, not negligent is the end all....

THE MANDATORY HOURS THAT A NURSE IS REQUIRED TO WORK ARE INHUMAN! NOT ONLY ARE WE ALREADY STRESSED AND OVERWORKED DOING AOUR REGULARE SHIFTS THEN WE ARE REQUIRED TO HAVE TO WORK MORE! NURSES BECOME MORE IRRITABLE AND MORE PRONE TO MAKE MISTAKES NOT TO MENTION THAT THEY ARE TOO TIRED TO SAFELY DRIVE HOME PUTTING THEMSELVES AND INNOCENT PEOPLE AT RISK FOR INJURY OR DEATH. WE RECENTLY HAD A TECH CRASH AFTER WORKING HER MANDATORY DOUBLE SHIFT. SHE DIED INSTANTLY AND HER 3 YEAR OLD SON DIED A FEW DAYS LATER. THIS MOTHER LEFT BEHIND A HUSBAND AND ANOTHER YOUNG CHILD. THERE HAVE BEEN COUNTLESS EPISODES OF THIS HAPPENING.
I THINK THE NURSING PROFESSION IS IN ENOUGH TROBLE AS IS BUT TO MOT OVERTIME ALSO IS NOT GOING TO HELP WITH RETAINING STAFF OR IN CAREING FOR OUR PATIENTS....

H.R. 2122 would amend title XVIII of the Social Security Act to provide for patient protection by limiting the number of mandatory overtime hours a nurse may be required to work in certain providers of services to which payments are made under the Medicare Program.

Detailed Summary

Safe Nursing and Patient Care Act of 2007 - Amends title XVIII (Medicare) of the Social Security Act to place limitations on mandatory overtime for nurses, prohibit retaliation against them in any manner with respect to any aspect of employment, and establish civil money penalties for violations of this Act.

Directs the Secretary of Health and Human Services to study and report to Congress on standards to establish for the maximum number of hours that a nurse may work without compromising the safety of patients.

Requires the Director of the Office of Management and Budget to study and report to Congress on the extent to which federally operated medical facilities have in effect practices and policies for overtime requirements for nurses that are inconsistent with the requirements added by this Act.

Status of the Legislation

Latest Major Action: 5/15/2007: Referred to House subcommittee. Status: Referred to the Subcommittee on Health.
