Department of Homeland Security Appropriations Act, 2008 - Makes appropriations for the Department of Homeland Security (DHS) for FY2008, for: (1) the Offices of the Secretary, the Under Secretary for Management, the Chief Financial Officer, the Chief Information Officer, the Federal Coordinator for Gulf Coast Rebuilding, and the Inspector General; (2) Customs and Border Protection (CBP); (3) Immigration and Customs Enforcement (ICE), including for the Federal Protective Service; (4) the Transportation Security Administration (TSA), including for Federal Air Marshals; (5) the Coast Guard; (6) the Secret Service; (7) the Office of the Under Secretary for National Protection and Programs, the National Protection Planning Office, and the U.S. Visitor and Immigrant Status Indicator Technology (U.S.-VISIT) project; (8) the Office of Health Affairs; (9) the Federal Emergency Management Agency (FEMA), includind for the U.S. Fire Administration; (10) Citizenship and Immigration Services (CIS); (11) the Federal Law Enforcement Training Center; (12) the Office of the Under Secretary for Science and Technology; and (13) the Domestic Nuclear Detection Office.
Withholds specified funding until expenditure plans are submitted with respect to the Coast Guard's Deepwater acquisition program and the SBInet border technology and infrastructure procurement program.
Requires the Secretary to obtain information monthly from every prison, jail, and correctional facility in the United States to identify incarcerated aliens who may be deportable and make every reasonable effort to remove such aliens judged deportable upon their release from custody.
Prohibits the use of funds for deployment or implementation, on other than a test basis, of the Secure Flight program or other passenger prescreening program until specified requirements have been met.
Directs: (1) the Secretary of DHS to research, develop, and procure new technologies to inspect and screen air cargo carried on passenger aircraft; and (2) TSA to utilize existing checked baggage explosive detection equipment and screeners to screen cargo carried on passenger aircraft to the greatest extent practicable at each airport and to report air cargo inspection statistics quarterly.
Amends the Department of Homeland Security Appropriations Act, 2007 to: (1) require chemical facility site security plans to be treated as sensitive security information; and (2) not preclude or deny the right of any state or political subdivision to adopt or enforce any chemical facility security regulation that is more stringent than one issued under such Act.
Directs the Commissioner of CBP to establish a new classification for the CBP officer position that shall include eligibility for retirement benefits accorded to law enforcement officers.
Prohibits funds from being used by CIS to grant an immigration benefit to any individual unless all required criminal history and other background checks have been completed.

The Commissioner of United States Customs and Border Protection shall, not later than July 1, 2008, establish for the United States Customs and Border Protection Officer (CBPO) position, a new classification (`CBPO/LEO'), which shall be identical to the current position description for a CBPO, and include, but not be limited to, eligibility for treatment accorded to law enforcement officers under subchapter III of chapter 83, and chapter 84 of title 5, United States Code....Look up the rest. Ran out of char.
Guess this means Congress doesn't want CBPO to enforce laws?? Just try to spot a danger and REPORT IT. Am I wrong to assume this?

CBP (LEO retirment) the language gets included in its final version......differences between the two bills have not been worked out in the senate as of yet.do not go by h.r 1684, because so many changes were made to that bill it got a new number...h.r 2638

It protects us against terrorists and the aftershock. This bill just doesn't work, though. Waste of money, unhappy citizens, more taxes!? Who wants that!?

November 5, 2007, 2:17pm (report abuse)This bill is now in conference committee with the Senate version, S 1664. The House version includes an appropriation of $50 million for implementing the Real ID Act. Efforts to add to that funding in the Senate were defeated. The ACLU and 65 other organizations have sent a letter to the bill conferees asking them to strip funding for this failed, invasive program.
