This bill is very necessary to become the law as for last many years all FBI name checks are thrown to back burners by FBI without any sensitivity that the lives are on hold for all those families/people who are waiting for these results to be sent back to USCIS.
FBI is taking 3-4 years in sending these results back to USCIS and till then USCIS sits and do nothing about any application.
People who voted "No" may not have any idea that how bad present situation is and why this oversight is necessary. As per USCIS ombudsman 2007 report, FBI Namecheck is not serving its intended National Security Objectives.... because till the time FBI sits on these (3-4years) , a person get to remain inside US. A person that really wants to harm someone will not wait to get this namecheck done. Hence, this is not serving the intended National Security objectives and I think the PA based company who designed this software for FBI has seriously flawed algorithms and generate lots of false positives.

If someone is a legal alien, paid his taxes, paid the application fees for USCIS. Then Government should reward them by giving them the status of permanent resident or citizenship.

The agencies, FBI and USCIS, are breaking the federal laws:
1.The name check procedure was introduced in addition to the criminal background check without following a proper administrative procedure for the new regulation;
2.The law requires USCIS to make a decision on the case within 120 days after the interview and exam (2 years and still waiting in my case).
Is this a law obiding and democratic country we are all want to be citizens of?

It is even worse for I-485 AOS applicants. The law at least allows for Naturalization petitioners, who applications have been delayed longer than 120 days to ask the court to intervene on their behalf. However, Congress left the deadline out of the law for those seeking to become a Legal Permanent Resident. Courts are saying that they have no jurisdiction to hear the matter as the subject, including the pace of the process, is purely at the discretion of the USCIS/DHS/Attorney General. Therefore, LPR applicants stuck in the FBI NAME CHECK backlog can only wait until it clears...or Congress changes the law.

The fact that immigrants are willing to wait out the seemingly interminable immigration process shows the value that they place in living in the USA. As a country that prides itself on justice passing this bill and insisting on its observance can help to further that process. The present scenario is injustice of extraordinary proportions.

The namecheck process is supposed to be helping in weeding out the bad elements. By having this check stretch out for 1-4 years gives these very same bad elements a lot of time to cause harm to the society. It is in the interests of national security as well that these checks should be processed in a matter of weeks.

I have a friend is stuck with this FBI name check for a few years with his PR process. This is really a painful process, especially for those who have family in other countries because this will cause them very difficult to go back during these painful years. I think the evidence of their royalty and honesty in US should be adequate for FBI or INS to trust that the person is qualified or not for the PR. It's really frustrating that nothing can be done to solve the problem. I am just wondering why nobody introduces the similar premium processing which already exists for other applications such as H1B & I-140. We understand government is under tight budget and we/somebody are willing to help. 500$? 1000$? 2000$? And how long does it take? One month? Two month? Please just put a price tag and time line on it. Most of us already paid thousands for the application and attorney fee and waited for years. Those who are able to afford it will pay it. FBI will use those extra money to complete those cases and maybe even improve the current system. This will also benefit those who can not afford this premium processing fee since the less cases pending, the more likely their cased will be processed by someone. Already many people are suing USCIS and FBI out of desperation. So why waste everybody's time and money on those meaningless law suite instead of providing an option for people.

It seems SA has a good solution for name check by paying for premium processing. I would like to pay $10,000 to stop this agonizing and endless pain. It really hurts me more than a cancer.

I am one of those in agony. Being in high tech area, my work can lead to many possible frontier technology development, including those for novel civil and defense applications. Yet it seems very few people in the main stream (Government, media etc) cares for us in seeking legal routes to immigration. Due to this name check blockage, my family is about to break apart and I am struggling to keep life moving on. However, as I was interviewed by an USCIS Official on the subject, what I was told that I were already making a lot of money and I could wait longer since the only impact is limiting me from making more money. What a logic!

I filed for naturalization in 1998. FBI name check never been back to CIS. Case is still pending. What I have done are as fellows:
1. have renewed fingerprints for 8 times.
2. have written many letters to CIS director.
3. Have congressman write to CIS director.
4. have called CIS and visited local CIS uncountable times.
5. received letters from Congressman and CIS district directors. All told me "We are waiting for FBI background check".

This bill is absolutely necessary to help all immigration applicants that have been suffering and ignored for years. I filed my 1-485 since June 2005 and I am still waiting for my application to be adjudicated due to the FBI name check. Next year will make it 3 years and I am still waiting. I now there are people out there that have been waiting 3 to 6 years. I have gone through a lot during these years and it is unfair that any body has to go through this. My name should not make me a victim of discrimination. I have been a lawful resident and yet, I feel like I am a criminal if it will take 3 years to do a name check on me.

this bill would only allow the rehiring of retired federal workers with less problems if they work on the backlog. it's BS and will accomplish nothing.

I applied for the US citizenship in July 2003.
I have passed my interview, US History and English language test on December, 10, 2003.
Since that time, I have been waiting for an oath ceremony. I have been waiting the ceremony almost for over four years! And who knows how long would it take.
In February, 2006 I have submitted a Freedom of Information Act request for any records the FBI might have on me. The bureau promptly replied that it has none.
If FBI can inform me that they do not have anything against me, why can’t they inform about that immigration?
I want to participate in political life in this country, I want to have right to vote! It's so humiliating waiting my name to be clear for four years. Please, pass this bill.

Hi, we are lawful immigrant, staying in this county almost close to 10 years. for N-400 USCIS are still doing Name check. Did not you do the security check when I came to US. Please help pass this Bill, the name check delay has left us frustrated. our case has been pending on the name chack for over 3yrs. Not to mention the money (over $2000)that have been spent on extending the work permit and travel documnet for my husband. This is undue suffering and unfair for law abiding, tax paying individuals who just want to carryone with their lives with out this ever hanging sword on our head. Evryday i stop at the mailbox awaiting just one letter. This needs to be done.
